These Terms of Use (the “Agreement”) govern the use of the mobile application “Flashcards: Learn Anything” (the “Application”, the “App”), available via the Apple AppStore at https://apps.apple.com/app/id6755054883, provided by Dmitrii Belousov, individual developer (natural person) (the “Rights Holder”, “we”, “us”, “our”).

By installing the App, launching it and/or using its functionality, you (the “User”, “you”) confirm that you have read, understood and agree to be bound by this Agreement.

If you do not agree with the terms of this Agreement, do not install or use the App.

1. General Provisions

1.1. This Agreement is a legally binding contract between you and the Rights Holder that sets out the terms and conditions for the use of the App, as well as the rights and obligations of the User and the Rights Holder.

1.2. The App may be used only under the terms of this Agreement. Your installation, launch, or actual use of any functionality of the App constitutes your acceptance of this Agreement.

1.3. This Agreement applies together with:

• the Apple Media Services Terms and Conditions and the standard Apple End User License Agreement (EULA), if you download the App via the App Store; and
• the App’s Privacy Policy, which describes how your personal data is processed.

In the event of any conflict between this Agreement and Apple’s standard terms, Apple’s terms will apply to the relationship between you and Apple, while this Agreement will apply to the relationship between you and the Rights Holder.

2. Description of the App

2.1. The App is a tool for creating, storing and studying educational flashcards (text, images, audio) for languages, exams, quizzes and other learning purposes.

2.2. The App may provide, among other things, the following features:

• creating, editing and studying flashcards;
• organizing flashcards into folders/sets;
• adding images (including from third-party libraries) and audio (recordings or audio files);
• study and review modes and learning tools;
